The Commissioners outlined the broad framework of how the Inquiry will proceed over the coming months.
The government has set a report back deadline of 1 November 2004 and to meet this deadline the Commissioners would have to finalise their report by mid-September to allow for production and publication.
The Commission has appointed Mary Scholtens QC and Kieran Raftery as Counsel Assisting the Commission.
Three parties were formally recognised by the Commission - The NZ Police (represented by Kristy McDonald QC and David Bolt), the Police Complaints’ Authority (John Upton QC) and the Police Association (Susan Hughes).
The Commission will appoint staff to specifically engage with people whose personal experiences may fall within the Terms of Reference of the Inquiry. If it is confirmed that they have evidence which is relevant, this will be briefed by Counsel Assisting the Commission. Such people, and those about whom complaint is made in any way, will be accorded rights as interested persons for the relevant part of the Commission’s proceedings.
It has been determined that, at least in the first instance, the Commissioners will consider the relevant Police policies and procedures within a 25 year period from 1 January 1979.
The Commission will hold its next public session on 8 April to hear submissions on definitions which have been sought about the Terms of Reference and to consider issues which arise with regard to files which have been involved with Police Complaints Authority inquiries.
In the week commencing 24 May, the Commission will receive evidence about the police practices and procedures. It will then begin hearing evidence with regard to specific instances about which complaint has been made from the week commencing 14 June 2004.
